1. www.Last-Minute-Dive.com (LMD) solely provides single travel services. LMD cannot be held responsible for complaint-free supply of arranged travel services.

2. Owner of LMD and holder of the domain L-M-D.com is Monique Walker Dive Expeditions, Hostatostr. 9, 65929 Frankfurt/Germany.

3. The following General Terms and Conditions of Business, in addition to the contractural determinations, regulate the privity of contract between the requester and LMD and are valid for the placements provided by LMD.

4. The terms and conditions of each vessel owner/operator, published on their own websites, are the basis of contract between the booking person/s and the vessel owners/operators.

5. LMD is not responsible for the content of linked websites of other parties. LMD cannot be held responsible for any damage or loss caused by the contents or by the use of linked websites.

6. LMD cannot be held responsible for circumstances or events that happen outside its sphere of influence; in particular this applies to all services rendered by telecommunication companies and other providers and also to the correct function of technical equipment (hard- and software) outside the network of LMD.

7. Force Majeure: in case of force majeure that hinders LMD from meeting its liabilities, LMD is excused from meeting its liabilities until the end of force majeure.

1. A binding booking is accomplished by filling in the electronical order form and forwarding this order form to LMD (clicking the button "book"). This is regarded as a legally binding placement of an order with LMD for performing an arrangement between the requester and a vessel owner/operator.
LMD confirms booking by sending a confirmation e-mail which includes the invoice.
As the principle "first come - first served" applies, a booking for LMD will not become fully binding prior to the sending of the confirmation by e-mail.
Is one booking request later received than another request and therefore a booking is not possible, the sender of the later request will be informed by LMD asap.

Prior to forwarding the electronical order form to LMD there is no liability on side of the potential requester.

2. By forwarding an order form to LMD the requester confirms that he is legally competent and has reached the age of majority

3. As soon as the money that has to be payed for the booking is received irrevocably at the bank account of LMD, the customer will be provided with a voucher by LMD on behalf of the vessel owner/operator. The voucher is sent by fax or post.
As soon as the voucher is received by the customer, LMD cannot be held responsible for any issues concerning the journey or the correct fulfilment of the booked items.

In case of cancellations or if the customer does not turn up to set out on the journey/diving trip (No-show), LMD will charge the normal cancellation fees calculated by the vessel owners/operators.

1. A request for a booking is handeled considering the valid data protection law.

2. For the purpose of performing a booking, data concerning the customer is collected, saved and transfered if necessary for the booking process. The customer explicitly gives his consent to this form of data acquisition and transfers.

3. Data concerning the customer will solely be transfered to parties which are involved with the booking. The data is only used to perform the booking. There will be no transfer of personal data to third parties which are not involved with the booking.

4. Data transfer via the internet is not protected against access by unauthorized persons. Therefore, persons with specific knowledge could be able to read and process data they get access to. The risks for this abuse during data transfer via the internet is taken by the customer. LMD cannot be held responsible for outcomes that are caused by unauthorized access of unauthorized persons.

5. Remarks on passport requirements, visa, foreign exchange, health and conditions of entry

The customer/fellow traveller is responsible for all requirements being met to set out on a journey. This includes legal requirements, conditions of entry, exit permits and other documents.

If there is any doubt or need for more information the customer/fellow traveller is advised to contact the embassy of the country he will travel to or the embassy of his home country.

LMD provides links to websites of institutions/countries where information is available. LMD cannot be held responsible for the accuracy and completeness of information given on these linked websites.

LMD recommends to take out travel cancellation insurance; and other insurances (travel health insurance etc.) , if necessary.

Should any of the above given terms and conditions be or become invalid, nevertheless all other terms and conditions remain valid. The effectiveness of the placement of an order with LMD for performing an arrangement remains unaffected.
